Legislation: “Possession of 25 grams or less of marijuana is punishable by a fine of $100 for the first offense. For the second offense, the penalty increases to a $200 fine and for subsequent offenses the fine increases to $250 and a maximum of 15 days in jail time may be imposed. [for a third offense the website shows it as a potential misdemeanor of up to 5 days jail time and/or fine up to $250]

Possession of greater than 25 grams or possession of any amount in public where the marijuana is burning or open to public view, is a class B misdemeanor and is punishable by up to three months in jail and a fine up to $500.

For possession of greater than two ounces, the penalty increases to a possible one year in jail and a fine up to $1,000.

Possession of greater than eight ounces increases the penalties to a possible one to one and a half years in prison and a fine up to $5,000. The penalties for possession of greater than 16 ounces are one to two and a half years in prison and a fine up to $5,000. For possession of any amount greater than 10 pounds, the penalty is one to five and half years in prison and a fine up to $5,000.

Delivery or manufacture of two grams or less of marijuana for no remuneration is punishable by up to three months in jail and a fine up to $500. [NORML also mysteriously writes “2 oz or less gift: class B misdemeanor | 3 months and/or fine | $500″] For delivery or manufacture of 25 grams or less, the penalty is up to one year in jail and a fine up to $1,000. For amounts greater than 25 grams, the penalty increases to one to one and a half years in jail and a fine up to $5,000. Delivery or manufacture of greater than four ounces is punishable by one to two and a half years in prison and a fine up to $5,000. For any amount greater than 16 ounces, the penalty increases to one to five and a half years in prison and a fine up to $5,000.

Any sale or delivery to a minor is punishable by one to two and a half years in prison and a fine up to $5,000.

Possession or sale of paraphernalia is punishable by up to one year in jail or a fine up to $1,000.” [For possession at the least “must be dirty paraphernalia”]

Note: “The guide does not list penalties for every marijuana offense nor every enhanced sentence such as possessing marijuana near a school, involving a minor, and automatic driver’s or professional license suspension. Your state may require an enhanced sentence even if the enhancement is not in the guide.”

Another website said NY law uses the number 25 grams because pot used to be sold in a “lid” of up to 25 grams each. According to Wikipedia, Oregon decriminalized small time possession in 1972. Perhaps New York decriminalized first and second offenses some time after that during the 70’s as well while these lids might have been popular. On the dark side, the decades-old Rockefeller Drug Laws of NY enacted very serious penalties including life in prison and to some degree they seem to remain for offenses involving large quantities or crimes other than possession and still apply to most other substances.

Law Enforcement: Cops patrol teh areas. No DT’s (undercovers) sell weed. If you have out of state plates, don;t get surprised if you get stopped. When you do leave uptown, stick to the main streets, NOT the side streets

Marijuana is illegal in NY, and that is enforced by the police – NY Police have been busting people for extremely small quantities for about the last 8 years. If NY cops catch you with ANY weed they absolutley will arrest you and detain you in a NY jail for 48 hours. back in the 70’s, 80’s and early 90’s they would let you go but this is no longer the case. There are special police squads in NY who’s sole purpose is to find people smoking weed or drinking beer in public and arrtes them. Everyone who lives here and smokes knows about it.

Undercover NYPD, known as TNT( Tactical Narcotics Task ) work in teams observing drug locations. When I say drug, I include cannabis, as the cops don’t care if you have one dime sack of haze or a ounce of heroin, they will arrest you all the same. What they do is observe a spot from a distacne and always in an unmarked vehicle. They then watch the hand to hand deal, wait for the BUYEr to walk off away from the view of the dealer, then POUNCE on BUYER! I’ve seen people go to jail for an EMPTY bag, a roach or even a seed. If it’s TNT day aka BUST DAY your going down. Again, if you buy anywhere in the 5 boroughs KNOW your dealer and always try to do the deal indoors. But even if the spot is INDOORS, if the undercovers see you leaving a KNOWN DRUG SPOT, they will bust you the same.

Where to buy Marijuana in New York:

Pertains to Upper Manhattan, Uptown. 179st off George Washington Bridge, Dyckman projects, Post avenue.

Best call: “papi, who got that work? or who got that yerba”. It’s mainly Dominicans up here, and they don’t mess with you. A lot of youngsters working so if you look suspect they won’t give you the time of day. Best business minded sellers next to hippies. Most sellers are in a “conjunto” , group, so you get what you pay for.

also: The north end of union square park always has people smoking/selling there. some of the people there will try and hustle you for your money, but if your smart, you can get pretty good shit there. the best thing to do is find someone whos shit is legit, and get their cell number

If you ask around, there are delivery services where you call an answering service and leave your address and someone brings it to you. I’ve done this before, great product and convenient even though it costs more.

Washington Sq Park is a place where marijuana can be bought, but even during the daytime it feels somewhat dangerous. A few pointers:

– NEVER buy after dark (you will get ripped off or worse)

– NEVER buy in the toilet

– ALWAYS try to smell and get a brief look at the merchandise before you buy

– NEVER buy in Washington Square Park. There are hidden surveillance cameras now. Dealers will direct you to go to site some distance from the park where they will meet you.

– BE WARY of dealers that ask you to go more than a block or two away. They will set a trap where you will lose your money (not a mugging per se, but you will be in a compromised position in which you will likely be compelled to pay for bad marijuana or even no marijuana)

– Best place to meet dealers is right under the Arch near the entrance to the park.

– Best approach is to make brief contact with dealer near the Arch during daylight hours, meet somewhere a block or two away (if possible in a cafe or bar), evaluate the merchandise quickly, and pay the cash. Dealers who try to put you in compromising positions by saying “there are lots of police” around are probably setting you up for a scam.

Finally be aware of a bait and switch routine.

Our local reported recently updated: “A cautionary note as for washington square park – There are a few very aggressive dealers near the two dog runs.

They work in teams and try to push small bags on anybody that walks by. Beware, you will be ripped off and you will be putting yourself in a dangerous situation.”

“Your best and safest bet in NYC is to chill in midtown manhattan (timesqaure) find a guy that looks like he tokes ask where to find some haze, hell probablly have a hookup that’s somewhere safer. but it might cost more.”

There is a major differecence between the Park and 188th St, don’t let the fact that they both have “Washington” in the names. 188th St and Amsterdam is in the middle of Wash Heights, which is a working class ‘hood where the majority of residents are Dominican. Any pitching on 188 will most certainly be Dominicano and/or Latino, either speak English or not, and most probably WON’T sell to you if your White, or even if they don’t know you! See, pre- Guiliani days this was different of course. Just as someone mentioned that in the early 90’s you wouldn’t get arrested. In either case, only troop uptown if you are very street savvy, speak Spanish( preferred) and the best bet…KNOWING ur co

nnection. But in general yes, The Heights is famous for its potent weed and about 90% of the time the young “tigeres” or homeboys selling weed on the street are selling HAZE! Purple Haze and Wash Heights are synonymous.

I’ve been coppin weed in and around NYC since I was young snot nose, particularly in The Heights as that is where I grew up. Washington Square Park, and to a lesser degree Central Park( Sheep Meadow) is still the most popular weed cop destination in NY. But seriously, do we know ANYONE who is still buying there? Ummm, no. Washington Heights, on the other hand, has ALWAYS had killer weed. Back in the 80’s and 90’s it was most famous for being the biggest cocaine and crack hood in the World basically! Today, yes there is still all that bad shit, but weed is know what Wash Heights is famous for. The Haze especially which is VERY strong! I, personally, no longer buy on the street unless it’s emergency?? But the herb is crazy good up this way!”

I’d even say forget Washington Square Park altogether and try your luck at 176 and St Nicholas, 175th St and Audubon or if you cannot score for the life of you, try the Broadway entrance to the George Washingtin Bus Terminal at 178 St and Bway. Now, this is not a weed spot but one of the many hustling crack heads and junkies, for a price of course, will connect you with something. Whatever you do don’t let them have your money and let them run off. 9 times out of 10 for $5 they’ll lead you and introduce you to one of the herb dealers. all they want is that next blast of crack.
