Cannabis Laws and Legislation in Spain

Spain’s constitution gives considerable protection to what people do in the privacy of their homes and private places.

“The Spanish law says that personal behavior in a private place, and this includes private land and outbuildings, is protected by the constitution,” “The controversial issues are that police are allowed to determine if what you are doing is personal or if it is meant for distribution, which is illegal, they are also allowed to put a fine on you if your cannabis activities or possession are outside of your private domain.”

Law Enforcement

Drug use and possession for personal use do not constitute a criminal offense under Spanish law. However, public consumption can be penalized with administrative fines.

Public possession of less than two ounces of cannabis is not a criminal offense, although heavy administrative fines can be levied (from 330Euros up to 600Euros).

Possession of more than two ounces, growing for sale, or selling are considered criminal offenses, but prison terms are not as severe as those levied in the US.

There’s some public places where it might not be legal to smoke, but most people do it. Like the beach, some of the parks, and many places with good views like Montjuic or Parc Guell. Although, we strongly recommend people always smoke in their own private place or in a private cannabis club in order to avoid fines and uncomfortable situations with police.

Barcelona Marijuana Prices

The quality of weed and hash in Barcelona can sometimes equal that of California, as it is possible to find top shelf quality in more than one place. The difference is the price, its about half of what you will have to pay in other pot havens like Amsterdam. Find a good ”private club” and you can get a large gram (1g – 1.4g) for 8 EUR and a double (2g -2.8g) for 15 EUR. On the black market, the right person will offer you even higher prices, with just one kind of quality product much worse than the ones offered in the private smokers clubs. It’s better to avoid street deals, because like Forest Gump’s mom used to say, Life is like a box of chocolates, you never know what you’re gonna get. Your best and safest shot, if you don’t know anyone in town, contact barcelona@webehigh.org and you will get sorted out ASAP.

Cannabis clubs in Madrid are associations where members have legally put their collective skills, resources and funds together to cultivate marijuana and provide it in a safe environment to its members. The members and Board of Directors are organized as a closed-circle group of people who band together in a registered Private Association for the purpose of “autoconsumo” – to produce and consume cannabis. These clubs are non-profit and only require members to pay a small yearly fee and for their share of the harvest efforts.

Most clubs offer a selection of 5 – 6 Sativas and 5 – 6 Indicas. Madrid’s cannabis clubs also generally carry hash, iceolator and other types of concentrates, and a few clubs might offer edibles from time to time.

Inside a cannabis club in Madrid, you’ll find spacious areas to hang out, comfortable seating, places to work from, and well-stocked dispensaries and bars – that’s right, you can get beer and wine too!

Most clubs also offer coffee, tea and other beverages as well as snacks and sometimes even hot tapas. Free WiFi, live music and DJs, special events and late hours make Madrid’s cannabis clubs great places to hang out in addition to being able to score some excellent quality marijuana.

Where to buy marijuana in the Canary Islands

I was walking around las palmas downtown and there was a guy trying to sell something else in spanish. I asked for hash and we went to a couple of kilometres away from downtown by taxi (I payed it of course). He said hash costs 20€/10g and he would take half of it for resale profit. It was fine to me, since it was so cheap, but the result was really poor also. It was the crappiest hash I’ve ever seen, but considering the price, it was ok.

Tourist resorts are actually better places to find quality hash, there seemed to be someone always selling coke and hash outside those bar/club centres in Puerto Rico and Playa del Ingles. Quality hash cost 6€/g and was pretty good a-level product from Marocco.

Prices and Types of Marijuana

Really poor quality was 20€/10g, better quality hash from resorts was 5-10€/g. Moroccan hashes are everywhere, quality ranges from the poorest I’ve seen to very good 0-0 quality. You just need to find a good person.

Malaga, Spain

Smoking tolerance level [1= very illegal 5=virtually legal]: 3.5

Legislation: Cannabis is illegal in Spain but it is not a major concern if the police catches you with some pot as they will most likely just confiscate the gear and then leave.

Law enforcement: If visiting Malaga, watch out for police with names such as “Policia Local” (local police), “Policia Nacional” (you can probably work this one out), and “Guardia Civil” – the feared Military police – the civil guard.

The Local Police will most likely only confiscate the drugs alike the nationals but the Civil Guard will give you hell. My friend was threatened to be shot in the head for possession of 5 grams. They are corrupted assholes.

Where to buy marijuana in Malaga: Most areas will have available pot for tourists, but avoid areas such as Montemar and San Andrטs because the inhabitants have low respect for tourists. Benalmadena is a growing tourist town where morrocan hash can be found easily. Head for the Paloma Park and the skatepark as locals mobsters sit there. Just ask one of the hispanic boys ( usually between the age of 17 to 21 ) sitting on a scooter and ask for: “Chocolate” (choclate – common term for hashish). They will then ask you “Cuanto” being how much. Dont reply in grams or ounces just say the amount of money you wish to spend. eg. 10 ,20 euro or more. This is the safest way to hook up with some nice morrocan hash.

Malaga Marijuana prices: Morrocan hash is relatively cheap with the price being about 50 euros for and ounce and 10 euros for an eigth. Buds are a little more expensive but if you hook up with the right person ( usually english ) you can get some suberb mind blowing skunk. This is usually homegrown or imported from Amsterdam.

Brands: Morrocan hash is most widely smoked in southern Spain, being to close to Morroco. The potency is ranged – sometimes you can hook up with a massive block of hash for 10 euros but unfortunately the quality does not match its quality. And at times you can find blonde-coloured “Rubio”. This is the best you’ll get in Malaga. Skunk is also available but is unfortunately most scarce. However when you are lucky enough to get some the quality is never doubted and can be very to extremely potent.

Granada, Spain

Smoking tolerance level [1= very illegal 5=virtually legal]: 4.5

Legislation: Cannabis is illegal in Spain but it is not a major concern if the police catches you with some pot as they will most likely just confiscate the gear and then leave.

Law enforcement: Spain is a lot more worried about hard drugs (which are also easy to come by here)

Where to buy marijuana: The street Calle Elvira, is the pot capital of Granada. Avoid getting hit by stoned drivers in this narrow street, but just wait a few moments and someone will offer you some. Also, the Plaza Nueva region is home to some wonderfully friendly English speaking homeless hippies who have loads of it. Finally, along Gran Via, in front of CajaGranada lives a guitar playing hippie who has some.

Marijuana prices: As long as you look like you know what you are doing, you can get it for 6-8 euros a gram. Otherwise, you may end up paying 12 euros or more.

More information: Calle Elvira is a good place to look, the hash here comes from Morocca directly and is amongst the best hashes in the world.

You can get local weed for 1-2e a gram.

The Moroccan hash (known as caramello) usually comes in small oval packages (that has been up someones arse) and is around 50/60e a go. Well worth a try.

Watch out for unscrupulous gypsies.

Jerez de la Frontera, Spain

Smoking tolerance level [1= very illegal 5=virtually legal]: 4

Legislation: Spain’s constitution gives considerable protection to what people do in the privacy of their homes.

“The Spanish law says that personal behavior in a private place, and this includes private land and outbuildings, is protected by the constitution,” “The controversial issues are that police are allowed to determine if what you are doing is personal or if it is meant for distribution, which is illegal, and they are also allowed to arrest you if your cannabis activities or possession are outside of your private domain.”

Law enforcement: Of course, there is police here, but they haven’t done anything to me yet! I don’t really know how to describe it, but they’re not aggresive- I can say that for sure!

Most likely they will look the other way, as long as you don’t “force them” to see you. Don’t be an idiot, an you will be OK.

Where to buy marijuana: Seriously, I’ve just been walking around in all the “mini-parks” around the city-center, looking for groups of teenagers, they’re all very friendly.

They don’t speak much english, but if you manage to say “porro” or “chocolato”, i’m sure they’ll understand 😉 I’ve been here for two weeks now, and i got some the first day i actually asked someone! And now i just walk to the park whenever i want some. But keep in mind that the spanish people don’t go out until LATE, so don’t go out at eight o’clock, there are no kids then 🙂 Wait until at least 11, 12 at night. An keep in mind that Jerez is VERY close to Morocco, so the quality is… well 🙂 Haha, i’m just so happy!

One thing i almost forgot to say, i have not seen a singel pusher, so i freaked out the moment i got here. But who needs criminal dealers when the youth is so helpfull?

Marijuana prices: The price varies from time to time. I’ve gotten as little as 1g for 10 euro, and i have also gotten 4g for 20 euro. I’m so stoned, i almost forgot. I just got 10 grams for 40 euro!

Marijuana brands: I’ve only gotten hash (which i prefer), but taken it’s legal to grow in your own house, it shouldn’t be that hard to find grass…

The hash is very soft, bubbeling. You know, real hash! Both pollen (light), chocolato (darker) and ICE-O-LATER (“Black-dark”).

Marbella, Spain

Smoking tolerance level [1= very illegal 5=virtually legal]: 4

Legislation: Weed is illegal, but is acceptable in small amounts, where it will simply be taken away. In fact, it is common for people to smoke in public areas, in broad daylight. Of course, this does depend on the law enforcement, as technically, you can still be nicked for its possession. Dealing is a more serious matter, as usual, and will not be dealt with so lightly.

Weed is actually a huge part of the culture down here and is freely smoked in plazas and parks.

Law enforcement: The local cops are usually extremely relaxed, and often quite friendly. They will often let you go on a warning or even ignore any light offenses. However, the guardia civil – the military police – are not so, and will most likely make things hard for you. In the end, they’re all pretty corrupt, and the right amount of money can get you out of any situation. It helps to speak Spanish, or at least try to.

Where to buy marijuana: The one thing to keep in mind if you’re a tourist is to not go up to the Spanish gypsy kids. These are the ones dressed in trackpants with strange haircuts (basically chavs) who drive scooters, etc. Nearly all of them will act ‘unfavorably’ to tourists.

A lot of the time people will come up to you – mainly Moroccans or Spanish. Enough time walking around Plaza Naranjos in Marbella or Puerto Banus at night and someone will fish you out. As with the cops, attempt to speak Spanish – it’s better than speaking in English, as you’re implying they should adapt to you and they might take it offensively.

The safest bet is to go to Puerto Banus and ask any 15-19 year old who looks middle-class. When everyone’s wasted enough, the whole thing is just a big mashup and you can pretty much find what you want.

Marijuana prices: Hash is cheap as it comes straight from Morocco. It is generally called pollen or chocolate, with white hash being called pollen or pan de igo (the highest quality). Darker hash is usually called Pakistani.

The weight system is NEVER used, except with upper class weed, which is extremely difficult to get your hands on.

Overall, it’s pretty hard to get weed, as hash is so popular, but if you do manage to get your hands on some, expect a premium, and dont expect anything special. Only the English kids ever actually use strain names, so don’t bother asking unless they tell you.

It’s a bit of luck, as sometimes you’ll get nothing and sometimes you’ll get completely hooked up. No weed economy is really established here – everyone just does their own thing.

San Sebastian, Spain

Legislation: Spain’s constitution gives considerable protection to what people do in the privacy of their homes.”

Law enforcement: Won’t hassle you, but do not expect to freely smoke wherever you want without care, keep it discreet. Do not try and bribe them.

Where to buy marijuana:
There’s at least one head shop with The Leaf displayed prominently on a flag outside. I don’t remember exactly where it was, but it was close to the beach, and I think, the aquarium. But they had a plant growing in the store and you could buy seeds. I asked about some bud, and the guy at the store told me to come back later, and the deal was made.

Marijuana in San Sebastian is legal to grow for ones own consumption, hence why all the head shops around openly sell seeds. Although some attendants at these shops may not be very helpfully when asked (they very scared of undercover police officers) it is still relatively easy to find. Go to the beach (not the main beach Beach of La Concha) but the one further down where all the surfers hang out. On the other side of the river. There you can ask pretty much anyone, especially the Moroccans.. Most of these peple will have Hash on them but if you’re looking for Bud you may have to follow them until they collect it.

When i was there me and my mates walked for about 20 minutes with this 1 moroccan guy into the park/ forest up the hills of San Sebastian (Lau Haizeta Parkea.) I’m pretty sure there are heaps of bushes with bud growing in there because he found a GIGANTIC plastic bag and filled it with fresh bud for us.. Was awesome

Marijuana prices: I paid 15 euro for a small, say week-long, stash of bud (if you don’t smoke a lot).

Marijuana brands: I don’t know which strain but it was good pot.

Seville, Spain

Smoking tolerance level [1= very illegal 5=virtually legal]: 5

Legislation: it is legal to grow in your home. because Spanish drug laws are limited to public space, you only have to worry about the law if you’re toking up on a street, museum or in a park. If you do get caught, possession of up to 50 grams of cannabis is considered for personal use and there are no criminal penalties. If you have large stashes and they must be quite large divvied up into smaller portions you will probably be tagged a dealer and hit with an “attempt against public health” charge, which can carry a prison sentence.

Law enforcement: Not in Seville.

I barely ever saw cops when I lived in Sevilla. I had no problem walking down a side street and taking a couple puffs on a pipe or porro(joint). Many Spaniards do it themselves.

Where to buy marijuana: The best thing to do when you want to buy is to ask around at bars and clubs. Look for people smoking themselves or people you think smoke. You will generally pay more, the quality is poor, and you get less. But, you can also get lucky and meet someone who grows their own pot.

and also: “As the smoker before me has mentioned go to the end of Paseo de Colon. There is a little park there at the bridge but we found neither hippies nor smokers. However if you go down the stairs to the side of the river, you will find someone who sells. Just ask around. In our case it was Moroccan guys, fairly potent hash, good quality. ”

Marijuana prices: 20 euros for about 4 grams of hash. First buy this. If you want more, show more money after you have spend the first 20 euros and have tried a smoke. If you just say, ok give me the double of this for 40 euros they will try to sell you the first piece for 40 (we didn´t take it for 40 but paid 30 euros for what we would have got for 20; anyway it was good quality).

More information: There is a park at the end of el Paseo del Colon and calle Reyes Catolicos on the river. It is a great spot to hang out, drink a 40, and smoke. Its usually full of hippies on sunny days. The club Elefunk in Barrio de Santa Cruz is an awesome club that does not care if you smoke pot inside. Fun Club in Plaza de Alameda de Hercules is another great club that lets you smoke inside.

WeBeHigh City Tale:

You can sit in a couple of parks at Placa Encarnacion or near Placa de Espana and smoke there, no one ever approached us. Take enough to drink with you, so the heat will not kill you.

Smoke your day away in the sun in Seville, Spain, where locals and the law are so accepting of bud and hash that it is legal to grow in your home. Keep in mind Spain is the European country closest to Morocco and boasts more than 1500 years of cannabis and hash smoking history.

“You can always get something downtown — especially on some squares of the streets — if you don’t know where to get it,” said David from the United States, who was visiting Seville. Spanish pro-cannabis activists have even launched a “grow-your-own-stone” campaign to promote marijuana cultivation to wean people off dealers and onto home-grown.

“We’re teaching people to break their dependency on the black market while experiencing the joys of self-sufficiency,” said Felipe Borrallo, president of Spain’s largest pro-cannabis association ARSEC.

And because Spanish drug laws are limited to public space, you only have to worry about the law if you’re toking up on a street, museum or in a park.

When headed out to buy some smokeables, expect to pay about $4 to $5 for a gram of marijuana , which is usually mid to high quality or $15 to $20 for five grams. Moroccan hash, which can be of dubious quality, runs about $8 to $10 for five grams.

“If you get some pot, it is better for you,” said Rich, a travelling dope smoker. “It is very easy to find hash but the quality is very poor.”

The best time to take advantage of Spain¹s pot and hash is during the La Feria de Sevilla, a weeklong festival starting in April that draws more than one million people from around the world.

“In the afternoon a great party commences, with all-night flamenco dancing, entertainment booths, bullfights, horseback riding, flower-decked coaches, and dancing in the streets, said vacationer Ariel, after attending the festival. “This is repeated day by day over the course of an entire week.”

Sip some sangria at Real de la Feria a tent city near Rio Guadalquivir that is the centre of the festival, take a toke off your joint then head out to take in the flamenco dancing, bullfight and general rowdiness.

Running for about a mile, Real de la Feria¹s brightly colored canvas tents called casetas are lit with thousands of paper lanterns and are sponsored by everyone from aristocratic Spanish families to the local pubs. Flamenco dancing reigns inside most casetas from about 9 p.m. to 7 a.m. the next morning.

The most famous and notorious of the casetas is Er 77, where the wine is drawn in buckets from a well and some thoughtful person thought to stock the back with cots for napping.

Los Duendes de Sevilla, or the Goblins of Seville, is another caseta worth peeking into.

Stumble into the right casetas and you may find a friendly joint being passed around too.

After a long night of smoking up and drinking, try to wake up early enough in the afternoons to catch a glimpse of the ultimate Spanish spectator sport the bullfight.

The spectacle starts at 5:30 p.m. in the Plaza de Toros de Maestranza, known by local nickname “The Cathedral”, each afternoon. While kicking back in the late afternoon sun and riding a nice high, keep in mind you watching some of Spain¹s best matadors in the ring.

If you end up in Seville at other times of the year, never fear there are plenty of activities, sights and pot to keep you happy and high.

Swing by the Barrio de Santa Cruz for a taste of the local life.

The atmosphere at Casa Roman bar, located in Plaza de los Venerables, lies in the ranks of cured hams hung from the ceiling, while the Plaza Dona Elvira is a good area to try and score from the young guitar-playing locals.
